1. General Information

These Terms of Service (hereinafter “Terms”) regulate the legal relationship between the customer (“you”, “buyer”) and EMAkrone OÜ (“we”, “our”, “seller”) when purchasing goods from the online store www.ashleyjoy.ee.

By placing an order, you confirm that you have read and agree to these Terms.

2. Product Information and Prices

All product descriptions, prices, and availability details are shown on our website.

Prices are displayed in euros (EUR) and include VAT, unless otherwise stated.

The seller reserves the right to adjust prices and product information. Any such changes apply only to future orders and do not affect already confirmed purchases.

3. Purchasing and Payment

To purchase products, select the desired items, add them to your cart, and proceed to checkout.

You must provide accurate personal, shipping, and contact information to complete your order.

Payments for goods can be made using the methods displayed at checkout.

Payments are processed securely through MakeCommerce (Maksekeskus AS) and/or other authorized third-party payment service providers, such as licensed card processors or banking intermediaries.

These providers act as authorized data processors, processing only the information necessary to complete your transaction (such as name, order number, and payment reference) in compliance with GDPR and other applicable regulations.

We do not have access to or store your full payment card details.

All transactions are conducted securely and in accordance with financial and data protection laws.

Once payment is successfully completed, you will receive an order confirmation by e-mail.

4. Delivery

Orders are processed and dispatched within 1–3 business days after payment confirmation, unless otherwise stated.

Deliveries within Estonia are handled by Omniva, DPD, or Itella Smartpost and usually arrive within 1–4 business days.

Delivery costs and available options are displayed at checkout before payment.

We are not responsible for delays caused by courier companies or circumstances beyond our control (e.g. weather, strikes, customs delays).

5. Right of Withdrawal and Returns

Under the Estonian Consumer Protection Act and EU Directive 2011/83/EU, you have the right to withdraw from your purchase within 14 days of receiving the goods.

To exercise this right, please contact us at info@ashleyjoy.ee and provide your order number.

Returned products must be unused, unopened, and in their original packaging.

If the returned item is not defective, return shipping costs are covered by the buyer.
If the product is defective, damaged, or incorrect, return shipping costs are covered by the seller.

Refunds are processed to the original payment method within 7 business days after we receive and inspect the returned goods.

We reserve the right to refuse a refund if the returned item shows signs of use or damage not caused during delivery.

6. Defective Goods and Warranty

If a product arrives damaged, incomplete, or defective, please contact us immediately at info@ashleyjoy.ee and include photos of the issue.

We will repair, replace, or refund the defective item as appropriate and in accordance with Estonian and EU consumer laws.

7. Payment and Third-Party Service Providers

All payments are processed by MakeCommerce (Maksekeskus AS) and/or other authorized third-party payment intermediaries that securely handle payment transactions on our behalf.

Customer information required for payment (such as transaction amount, payer name, and order number) is securely transmitted to these intermediaries solely for the purpose of completing the transaction.

These intermediaries act as authorized data processors, processing personal data in accordance with GDPR and other applicable data protection laws.

We are not responsible for technical errors, transaction failures, or delays caused by payment intermediaries or banks, but we will assist customers in resolving such issues whenever possible.

8. Liability and Force Majeure

The seller is not liable for damages arising from force majeure events, such as natural disasters, strikes, war, technical disruptions, or third-party actions beyond our reasonable control.

Our total liability is limited to the value of the purchased goods.

9. Intellectual Property

All content on the website, including images, text, design, trademarks, and product names, is protected by copyright and intellectual property laws.

Any unauthorized use, reproduction, or distribution of website content is prohibited without prior written consent from EMAkrone OÜ.

10. Data Protection and Privacy

We process personal data in accordance with our Privacy Policy, which outlines how customer data is collected, used, and protected.

By placing an order, you agree to the processing of your personal data as described in that policy.

For payment transactions, MakeCommerce (Maksekeskus AS) and other authorized payment intermediaries act as data processors on behalf of EMAkrone OÜ.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Estonia.

If you have any complaints, please contact us first at info@ashleyjoy.ee — we aim to resolve all issues amicably.

If no agreement can be reached, disputes will be settled in Harju County Court (Estonia) in accordance with Estonian law.

Consumers may also turn to the Consumer Disputes Committee (Tarbijavaidluste komisjon) via www.tarbijakaitseamet.ee for out-of-court dispute resolution.

12. Changes to Terms

We may update these Terms from time to time to comply with legal requirements or improve our services.

The latest version will always be available on www.ashleyjoy.ee and will apply from the date of publication.
